Article XV, Public Utilities
§ 248-41. Standards and procedures.

A. All gas and water mains and telephone lines and television cables and appurtenances shall be installed in accordance with the construction specifications of the respective agency or district. Streetlights and lighting standards shall be in accordance with the construction specifications for public improvements as adopted by the Planning Board. [Amended 2-23-1971; 6-10-1975; 9-6-1988]

B. Electric, telephone, water, gas, television cable or any other public utility shall only be installed underground within the street or highway right-of-way, unless waived by the Town Board. On the application for waiver of the requirements of this section, as provided herein before, the Town Board may, in its discretion, refer the application to the Planning Board of the Town of Smithtown for its study and recommendation. C. A letter approving such a proposed installation and a statement as to who will carry out the construction, signed by a responsible official of the lighting agency, utility company or governmental authority or district which has jurisdiction in the area, shall be directed to the Chairman of the Planning Board and shall be received prior to the final plat approval.

D. The general installation and location of streetlights shall be at every street intersection, on every cul-de-sac and in general at every other property line, with a minimum distance of approximately 150 feet to a maximum of 200 feet. [Added 6-10-1975]
