ORDINANCE 03-8 AN ORDINANCE TO RELEASE, VACATE AND EXTINGUISH ANY AND ALL PUBLIC RIGHTS IN AND TO B STREET, C STREET, D STREET, E STREET, F STREET AND G STREET

Whereas, the Township Council in the Township of Pohatcong in the County of Warren is of the opinion that the public interest will best be served by abandoning, vacating, releasing and extinguishing any and all public rights which said Township may have in and to B Street, C Street, D Street, E Street, F Street, F Street and G Street.

Now, Therefore, Be it Ordained by the Township Council of the Township of Pohatcong, County of Warren, State of New Jersey, as follows:

1. The public rights and interests of B Street, C Street, D Street, E Street, F Street and G Street, particularly described as follows are hereby vacated, abandoned and released:

See Schedule A attached.

2. The following described rights of public utilities and CATV companies are hereby expressly reserved and excepted from this vacation;

Not applicable, these streets are paper streets. Furthermore, the Township Engineer has confirmed that the following utility companies do not have facilities within these streets:

Jersey Central Power & Light

Verizon



Consumers New Jersey Water Company

Elizabethtown Gas

Service Electric Cable TV

3. This ordinance shall be become effective twenty (20) days after final passage arid publication according to law and filing with the County of Warren as may be applicable.

VACATION OF PORTIONS OF B STREET, C STREET, D STREET E STREET F STREET AND G STREET

1. That portion of B Street extending from the northern right of way line of Center Street to the southern right of way line of Chestnut street, a distance of 300'+/-.

Said vacation to be a 20' wide strip bounded on the west by the existing right of way line of B street being the easterly property lines of Block 9, Lot 3 and Block 8, Lot 8 and on the east by the exiting right of way line of B street being the westerly property lines of Block 9, Lot 4 and Block 8, Lots 6 & 7.

Excepting therefrom that portion lying within the right of way of Victory Avenue, as shown on Sheet 2.02 of the Tax Map of Pohatcong Township annexed hereto.

2. That portion of C street extending from the northern right of way line of Victory Avenue to the southern right of way line of Chestnut Street, a distance of 125'+/-.

Said vacation to by a 20' wide strip bounded an the west by the existing right of way line of C street being the easterly property line of Block 8, Lot I 1 and on the cast by the existing right of way line of C street being the westerly property line of Block 8, Lot 10, as shown on Sheet 2.02 of the Tax Map of Pohatcong Township annexed hereto.

3. That portion of C Street extending from the northern right of way line of Middle Street to the southerly boundary line of Block 1, Lot 1, lands now or formerly of SAMUEL J. HEYMAN, a distance of 228'+/-.

Said vacation to be a 20' wide strip bounded on the west by the existing right of way line of C Street being the easterly property lines of Block 7, Lot 3 and Block 6, Lot 1 and on the east by the existing right of way line of C Street being the westerly property lines of Block 7, Lot 4 and Lock 6, Lot 2.

Excepting therefrom that portion lying within the right of way of Park Avenue, as shown on Sheet 2.02 of the Tax Map of Pohatcong Township annexed hereto.

4. That portion of D Street extending from the northern right of way line of Center Street to the southern right of way line of Chestnut Street, a distance of 300'+/-.

Said vacation to be a 20' wide strip bounded on the west by the existing right of way line of l) street being the easterly property lines of Block 10, Lot 3 and Block 11, Lot 9 and on the east by the existing right of way line of D Street being the westerly property lines of Block 10, Lot 4 and Block 11, Lots 8 & 8.01.

Excepting therefrom that portion lying within the right of way of Victory Avenue, as shown on Sheet 2.02 of the Tax Map of Pohatcong Township annexed hereto.

5. That portion of E Street extending from the northern right of way line of Center Street to the southern right of way line of Chestnut Street, a distance of 300'+/-.

Said vacation to be a 20' wide strip bounded on the west by the existing right of way line of E Street being the easterly property lines of Block 10, Lot 1 and Block 11, Lots 13 & 14 and on the east by the existing right of way line of E Street being the westerly property lines of Block 10, Lot 2 and Block 11, Lot 12.

Excepting therefrom that portion lying within the right of way of Victory Avenue, as shown on Sheet 2.02 of the Tax Map of Pohatcong Township annexed hereto.

6. That portion of F Street extending from the northern right of way line of Center Street to the southern right of way line of Chestnut Street, a distance of 300'+/-.

Said vacation to be a 20' wide strip bounded on the west by the existing right of way line of F Street being the easterly property lines of Block 17, Lot 4 and Block 16, Lot 6 and on the east by the existing right of way line of F street being the westerly property lines of Block 17, Lots 5 & 6 and Block 16, Lot 5.

Excepting therefrom that portion lying within the right of way of Victory Avenue, as shown on Sheet 2.02 of the Tax Map of Pohatcong Township annexed hereto.

7. That portion of F Street extending from the northern right of way line of Middle Street to the southerly boundary line of Block 1, Lot 1, lands now or formerly of SAMUEL J. HEYMAN, a distance of 335'+/-.

Said vacation to be a 20' wide strip bounded on the west by the existing right of way line of F Street being the easterly property lines of Block 15, Lot 5 and Block 14, Lot 4 and on the east by the existing right of way line of F Street being the westerly property lines of Block 15, Lot 6 and Block 14, Lots 5 & 6.

Excepting therefrom that portion lying within the right of way of park Avenue, as shown on Sheet 2.02 of the Tax Map of Pohatcong Township annexed hereto.

8. That portion of G Street extending from the northern right of way line of Center Street to the southern tight of way line of Chestnut Street, a distance of 300'+/-.



Said vacation to be a 20' wide strip bounded on the west by the existing right of way line of G Street being the easterly property lines of Block 17, Lots I & 2 and Block 16, Lot 8 and on the east by the existing right of way line of G Street being the westerly property lines of Block 17, Lot 3 and Block 16, Lot 7.

Excepting therefrom that portion lying within the right of way of Victory Avenue, as shown on Sheet 2.02 of the Tax Map of Pohatcong Township annexed hereto

That portion of G Street extending from the northern right of way line of Middle Street to the southerly boundary line of Block 1, Lot 1, lands now or formerly of SAMUEL J. HEYMAN, a distance of 335'+/-.
