ORDINANCE NO. 21-04 PROHIBITING CARPORTS WITHIN ANY RESIDENTIAL ZONE

"AN ORDINANCE PROHIBITING CARPORTS WITHIN ANY RESIDENTIAL ZONE WITHIN THE TOWNSHIP OF BERKELEY HEIGHTS"

BE IT ORDAINED BY THE TOWNSHIP COMMITTEE OE THE TOWNSHIP OE BERKELEY HEIGHTS AS FOLLOWS:

WHEREAS, no structure commonly referred to as a "car port", which is temporarily affixed or not affixed to real properly without a permanent foundation, which is enclosed on a maximum of three (3) sides and which is made of metal, wood, fabric or other material on a frame for the purpose of protecting its contents or any items contained therein from the elements shall be permitted in any Residential Zone within the Township of Berkeley Heights; and

WHEREAS, detached carports shall not be permitted in any residential zone district.

WHEREAS, the provisions hereof shall not apply to tents or similar structures between 100 and 900 sq, ft, designed for and intended to provide shelter for human occupants, which shall be subject to applicable fire codes and shall require necessary inspections. Any such tent over 900 sq. feet shall also be subject to applicable Building Codes and require necessary inspections.

BE IT FURTHER RESOLVED that this Ordinance shall be published and take effect pursuant to law.
