AN ORDINANCE TO AMEND THE ZONING MAP OF THE MUNICIPAL LAND USE PROCEDURES ORDINANCE OF THE TOWNSHIP OF BERKELEY HEIGHTS TO PLACE BLOCK 801, LOT 48 IN THE HB-2 DISTRICT

WHEREAS, the Township Committee has reviewed the land known as Block 801, Lot 48 and found it suitable for commercial development, and desires to classify said land as part of tire HB-2 Zone.

BE IT ORDAINED, by the Township Committee of the Township of Berkeley Heights, in the County of Union, State of New Jersey as follows:

1. The Zoning District Map of the Township of Berkeley Heights dated January 12, 1977 latest revised September 5, 1995 shall be further revised to place the following lot in the HB-2 Zone:

(a.) Lot 48, Block 801

2. Section 6.6.2 Zoning District Map of Part 6 Zoning of the Municipal Land Use Procedures Ordinance Township of Berkeley Heights shall be amended to add within the brackets at the conclusion of the section a reference to this Ordinance and its date of adoption.

3. In the event that any section, subsection, clause or phrase of this Ordinance is, for any reason, held to be unconstitutional or invalid by any Court, such decision shall not effect the validity of this Ordinance as a whole or any part hereof other then the part held to be unconstitutional or invalid.

4. This Ordinance shall take effect immediately after final hearing and publication according to law.
