WHEREAS, the Township Committee has bean presented with a request to rezone certain lands from 1-15 to 1-10; and | |||||||
WHEREAS, the 1983 Master Plan recommended that such a change be made; and | |||||||
WHEREAS, the Planning Board has indicated that the rezoning would be appropriate and would not be inconsistent with the Master Plan. | |||||||
BE IT ORDAINED by the Township Committee of the Township of Berkeley Heights in the County of Union and State of New Jersey as follows: | |||||||
1. The Zoning Map of the Township of Berkeley Heights originally dated January 12, 1977 revised to February 24, 1983. and further revised by Ordinance No. 9-89/Resolution R287-89, June 7, 1989 and by Ordinance 35-89 Section 3 adopted December 19, 1989 shall be further revised by changing from R-15 to R-10 the zoning designation for the lands bounded as follows:

Beginning at the intersection of the centerline of Plainfield Avenue and Bolton Boulevard and running in a generally westerly direction along the center line of Bolton Boulevard to the centerline of Park Avenue; thence along the centerline of Park Avenue to the point of intersection of the centerline with zone line dividing the present R-15 and CL zones; thence north a long said dividing line a distance of 125 feet; thence in a westerly direction on a line parallel to and 125 feet from the centerline of Park Avenue a distance of 250 feet : thence north along the current dividing line between the R-15 and OL zones 125 feet to the centerline of Columbus Avenue: thence westerly along the Centerline of Columbus Avenue to its intersection with the center line of Berkeley Avenue; thence southerly along the centerline of Berkeley Avenue to its intersection with the centerline of Park Avenue; thence westerly along the centerline of Park Avenue to-a point in such centerline representing the point .of intersection with the centerline of a La Grande Avenue if same were extended in a westerly direction; thence easterly along such extended centerline to the actual centerline and further along such centerline to its intersection with the centerline of Harwood Avenue; thence northerly along the centerline of Harwood Avenue to its intersection with the centerline of Plainfield Avenue: thence northerly along said centerline to the point and place of beginning. | |||||||
2. This Ordinance shall take effect, upon its publication after passage in accordance with law and approval by the Honorable John Pisansky, J.S.C., in accordance with the terms of the Order of Compliance and Final Judgment of Repose in Deland v. Township of Berkeley Heights, Docket No. L-73036-87 P.W.

AN ORDINANCE TO AMEND THE ZONING MAP OF THE MUNICIPAL LAND USE PROCEDURES ORDINANCE OF THE TOWNSHIP OF BERKELEY HEIGHTS TO REZONE THE LANDS IN THE AH-2 ZONE INTO THE OL ZONE | |||||||
1. The Zoning District Map of the Township of Berkeley Heights dated January 12, 1977 revised February 24, 1981 and June 7, 1989 as further revised December 19, 1989, July 2, 1991, September 5,1995 and May 19,1998 shall be further revised to place all lands currently in the AH-2 Zone in the OL Zone District. These lands include specifically Lots 1, 2, 3, 51, 52, 53, 54, 55, and 56 in Block 1901. AH-2, Section 6.6.2 Zoning District Map of Part 6 Zoning of the Municipal Land Use Procedures Ordinance of the Township shall be amended to add within brackets at the conclusion of the section a reference to this Ordinance and its date of adoption.
