WHEREAS, the Township Committee has been presented with a request to rezone certain lands from R-15 to HB-2; and | |||||||
WHEREAS, the lands in question are presently located adjacent to the business district and are more suitable for development as permitted uses in the HB-2 Zone than for residential use; and | |||||||
WHEREAS, the request has been forwarded to the Planning Board for comment and the Planning Board appears to believe that the requested change is appropriate and will promote proper development of the area. | |||||||
BE IT ORDAINED, by the Township Committee of the Township of Berkeley Heights, County of Union and State of New Jersey as follows: | |||||||
1. The Zoning Map of the Township of Berkeley Heights originally dated January 12, 1977 revised to February 24, 1981 and further revised by Ordinance No. 9- 89, June 7, 1989, by Ordinance 35-89 Section 3 adopted December 19, 1989 and by Ordinance 15-91 adopted July 2, 1991 shall be further revised by changing from R-15 to HB-2 the zoning designation for the lands bounded as follows:

Beginning at the intersection of the centerlines of Snyder Avenue and Woodland Avenue (a paper Street) and running thence along the centerline of Woodland Avenue in a generally easterly direction to the intersection of such centerline with the zone boundary for the OL Zone District, thence in a generally northerly direction along the OL-Zone District boundary line to its point of intersection with the boundary line for the HB-2 Zone District, thence continuing in the generally northerly direction along the line between the present R-15 Zone District and the HB-2 Zone District to the existing line running in an east/west direction dividing such zones, thence along such dividing line in a westerly direction to the centerline of Snyder Avenue, thence along the centerline of Snyder Avenue in a generally southerly direction to the point and place of beginning. (Encompassing Lots 31 to 47 inclusive in Block 801 together with the right of way for Mead Street, the northerly half of the right of way for Woodland Avenue and the easterly half of the right of way of Snyder Avenue from the centerline of Woodland Avenue northerly to the existing HB-2 Zone District.) | |||||||
This Ordinance shall take effect upon its publication after passage in accordance with law and approval by the Superior Court of New Jersey in accordance with the terms of the Order of Compliance and Final Judgment of Repose in Deland v. Township of Berkeley Heights, Docket No. UNN-L-73036-87 P.W. | |||||||
