ORDINANCE NO.51-2006

AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 211 (ZONING) OF THE CODE OF THE TOWNSHIP OF WAYNE BY REZONING PROPERTY ALONG ROUTE 23 SOUTH AND AMENDING THE ZONING MAP OF THE TOWNSHIP

WHEREAS, application for rezoning of the rear portion of Block 1616, Lot 55, located at 1515 Route 23 South was made to the Township of Wayne Planning Board, pursuant to Chapter 211, Section 211-1.1(D) of the Code of the Township of Wayne by 1515 Rt.23, LLC, owner of said property; and

WHEREAS, the Planning Board has reviewed the application and conducted a public hearing on the matter on May 8, 2006; and

WHEREAS, upon completion of said hearing, and after consideration of the testimony presented by the applicant, the Township professionals and members of the public who were heard concerning this matter, the Planning Board voted to recommend to the Township Council to rezone the rear portion of Block 1616, Lot 55 from IP, Industrial Park to HC, Highway Commercial, by virtue of the adoption of Resolution 20-2006, adopted by the Board on May 22, 2006.

NOW THEREFORE BE IT ORDAINED by the Municipal Council of the Township of Wayne, in the County of Passaic, State of New Jersey, as follows:

SECTION 1. Chapter 211, Section 211-2(A)(Classes of District; Boundaries Established; Regulations) of the Code of the Township of Wayne is hereby amended by rezoning the rear portion of Block 1616, Lot 55 from IP, Industrial Park to HC, Highway Commercial.

SECTION 2. The zoning map of the Township of Wayne referred to in Chapter 211, Article II, Section 211-2(B) of the Code of the Township of Wayne shall be amended in accordance with the provisions of this ordinance.

SECTION 3. If any section, sub-section, paragraph, sentence or any other part of this ordinance is adjudged unconstitutional or invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance.

SECTION 4. All ordinances or parts of ordinances which are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.

SECTION 5. This ordinance shall take effect twenty (20) days after final passage and publication as prescribed by law.
