AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 211 (ZONING) OF THE CODE OF THE TOWNSHIP OF WAYNE BY RE-ZONING CERTAIN PROPERTIES ALONG BLACK OAK RIDGE ROAD AND AMENDING THE ZONING MAP OF THE TOWNSHIP | |||||||
WHEREAS, the Township of Wayne desires to rezone a portion of Black Oak Ridge Road in the vicinity of Pompton Plains Cross- road which are presently zoned RB, Residential which zoning permits single family residential development on 15,000 square foot lots to B, Business; and | |||||||
WHEREAS, a land use analysis prepared by the Township Planner indicates that the majority of land uses in the affected area are commercial in nature and therefore, inappropriately zoned for residential development; and | |||||||
WHEREAS, standard planning practice as encouraged by the Municipal Land Use Law seeks to zone properties into conformity with zoning where appropriate; and | |||||||
WHEREAS, the Township of Wayne Master Plan seeks to promote sound land use policies consistent with protecting established land use patterns. | |||||||
NOW THEREFORE BE IT ORDAINED by the Municipal Council of the Township of Wayne in the County of Passaic, State of New Jersey, as follows: | |||||||
SECTION 1. Chapter 211, Section 211-2(A) (Classes of District; Boundaries Established; Regulations) of the Code of the Township of Wayne is hereby amended by re-zoning Block 2521, Lots 52, 53, 54, 55 and Block 3305, Lot 89 from RB Residential to B Business; | |||||||
SECTION 2. The Zoning Map of the Township of Wayne referred to in Chapter 211, Article II, Section 211-2(B) of the Code of the Township of Wayne shall be amended in accordance with the provisions of this Ordinance. | |||||||
SECTION 3. If any section, sub-section or paragraph, sentence or any other part of this Ordinance is adjudged unconstitutional or invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance. | |||||||
SECTION 4. All ordinances or parts of ordinances which are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. | |||||||
SECTION 5. This ordinance shall take effect twenty (20) days after final passage and publication as prescribed by law. | |||||||
