ACCESSORY USE, BUILDING OR STRUCTURE - A use, building or structure on the same lot with, and of a nature incidental and subordinate to, the principal use or structure
ACCESSWAY - An area intended to be used, and suitable for use, to give access to motor vehicles to the street from a lot and to a lot from a street.
ASSISTED LIVING RESIDENCE - A residential facility licensed by the New Jersey Department of Health in accordance with NJAC 8:36 to provide apartment-style housing and congregate dining and to ensure that assisted living services, as defined at NJAC 8:33H1.2, are available when needed to four or more adult persons unrelated to the proprietor. Each apartment in an assisted living facility shall have, at a minimum, one unfurnished room, a private bathroom, a kitchenette, and a lockable door on the unit entrance.

BUILDING - Any structure having a roof supported by columns or by walls and intended for the shelter, housing or enclosure of any person, animal or chattel.
DISTRICT - A district or zone referred to in § 100-3 of this Part 1.
DRIFTWAY - A roadway, thoroughfare, place or passageway sufficiently wide to accommodate motor vehicular traffic (including emergency vehicles), which is not a street as defined herein, but which, prior to March 7, 1953, has become established for use by owners of abutting land having no frontage on any existing state, county or municipal roadway for ingress and egress over the property of others, between a public roadway and the abutting properties. For the purposes of this Part 1, a private lane situated entirely on a single property shall not be considered to be a "driftway." [Amended 9-5-78]
DWELLING - A building containing one (1) or more dwelling units and being detached, that is, having no wall or walls in common with an adjacent dwelling or dwellings.
DWELLING, SINGLE-FAMILY - A dwelling containing no more than one (1) dwelling unit.
DWELLING UNIT - One (1) room, or rooms connected together, constituting a separate, independent housekeeping establishment for owner occupancy or rental or lease on a weekly, monthly or longer basis, and physically separated from any other rooms or dwelling units which may be in the same structure and containing independent cooking and sleeping facilities.
FAMILY - One (1) or more persons living as a single, nonprofit housekeeping unit as distinguished from individuals or groups occupying a hotel, fraternity or sorority house. The family shall be deemed to include foster children and necessary servants when such children and servants share the common housekeeping facilities and services, but shall not include more than four (4) boarders, roomers or paying guests.
GROUP HOME - As used herein, the term "group home" refers to an alternative living arrangement (also defined in N.J.A.C. 5:93-1.6) in which separate individuals or households live in distinct bedrooms yet share kitchen and some or all plumbing facilities, central heat and common areas. The term "group home" may include such uses as Class A, B, C, D, and E boarding homes as regulated by the New Jersey Department of Community Affairs, residential health care facilities regulated by the New Jersey Department of Health and community residences for the developmentally disabled, victims of domestic violence, persons with head injuries and the terminally ill.

HABITABLE FLOOR AREA - The total floor area of those portions of any dwelling unit used as living space, including kitchens, living and dining rooms, baths and bedrooms and hallways, but not including cellars, porches or attics, except expansion attics which may be finished to provide additional rooms without structural alterations to roofs or exterior walls.
HEIGHT OF BUILDINGS - Unless otherwise specified in this Ordinance, the height of buildings shall be measured from the average elevation of the ground level at the foundation of the building to the highest point of the highest ridgeline of the roof.

HOME OCCUPATION [Amended 11-4-1981 by Ord. No. 81-16; 12-19-1989 by Ord. No. 1989-13; 3-20-1990 by Ord. No. 1990-3] - A legal occupation conducted within a dwelling used as such, and/or in other existing buildings on a lot whose principal use is for residential purposes, provided that:
A. The occupation is carried on solely by the residents of such dwelling for financial or other renumeration as a use clearly incidental to and secondary to the residential use of the dwelling for domestic housekeeping and involves the employment of no person in such occupation who does not reside in such dwelling.
B. Not more than twenty-five percent (25%) of the total floor area of such dwelling shall be devoted to such occupation and at least one thousand (1,000) square feet of such dwelling remains for domestic housekeeping after twenty-five percent (25%) has been deducted. [Multiple home occupation may be permitted, provided that the minimum of one thousand (1,000) square feet remains and the limitation of twenty-five percent (25%) is not exceeded by all such occupations.] Provided that the foregoing provisions of this Subsection B are met, a 'home occupation" may also be conducted in a garage (whether or not attached to the house) or in any already existing building which is not a dwelling on the lot No new building or addition to an existing building shall be constructed and utilized for a 'home occupation." In calculating the floor area of the dwelling, for the purposes of this Subsection B, the area of any attached garage shall not be included.
C. There shall be no display of goods offered for sale in connection with such occupation which is visible from any street or adjoining lot, except as is permitted in § 100-45E.
D. No power equipment which is used to fabricate or manufacture a product for sale shall be used in such employment or occupation. (This shall not be construed to mean usual office equipment, such as typewriters, photocopiers and the like, which produce letters, reports, etc.) Also, no equipment or process shall be used in such employment or occupation which creates noise, vibration, glare, flames, odors or electrical interference detectable to the normal senses off the lot; and in the case of electrical interference, no equipment or process shall be used which creates visual or audible interference in any radio or television receiver off the lot or causes fluctuations in line voltage off the lot No trucks or mechanized construction or earth moving equipment used in such employment or occupation shall be parked or kept on the lot; provided, however, that no more than two (2) motor vehicles, which may be automobiles or pickup, panel or van-type trucks which do not exceed two thousand (2,000) pounds capacity, may be parked or kept on the lot when used in connection with a home occupation conducted from the lot
E. The dwelling in which said occupation is carried on shall retain an exterior which is characteristic of a building used for residential purposes. No structural changes to accommodate the "home occupation' shall be permitted, unless such changes are customary and normal for a dwelling used for residential purposes.
LOT - An integral parcel or plot of land or contiguous integral parcels or plots of land, under the same ownership, which are not separate subdivision lots of record
LOT AREA - The total horizontal area included within lot lines Where the front lot line is the center line of a street or lies in part or in whole in the street area, the "lot area" shall not include that part of the lot in use or to be used as the street.
LOT, CORNER - A lot located at the intersection of two (2) or more streets. A lot abutting on a curved street or streets shall be considered a 'corner lot" if straight lines drawn from the foremost points of the side lot lines to the foremost point of the lot meet at an interior angle of less than one hundred thirty-five degrees (135).
LOT DEPTH - The shortest horizontal distance between the front lot line (street line) and a line drawn parallel to the front lot line through the midpoint of the rear lot line. [Amended 9-15-87 by Ord. No. 1987-9]
LOT FRONTAGE - That portion of a lot extending along the street line. (See also the definition of 'lot width.") [Amended 9-15-87 by Ord. No. 1987-9]
LOT WIDTH - The straight and horizontal distance between side lot lines at setback points on each side lot line measured an equal distance back from the street line. The minimum lot width shall be measured at the minimum required setback line; provided, however, that the width of the lot between side lot lines at their foremost points (along the lot frontage) shall not be less than eighty percent (80%) of the required lot width except in the case of lots on the turning circle of a cul-de-sac, where the lot frontage shall be at least fifty (50) feet [Amended 9-15-87 by Ord. No. 1987-9]
NONCONFORMING STRUCTURES AND USES - Any nonconforming use or structure existing at the time of the passage of an ordinance may be continued upon the lot or in the structure so occupied, and any such structure may be restored or repaired in the event of partial destruction thereof.
OFF-STREET LOADING SPACE - Space logically and conveniently located for bulk pickups and deliveries, scaled to delivery vehicles expected to be used, and accessible to such vehicles when required off-street parking spaces are filled. Required 'off-street loading space' is not to be included as off-street parking space in computation of required off-street parking space
OFF-STREET PARKING SPACE - A space adequate for parking an automobile with room for opening doors on both sides, which space shall be a minimum of ten (10) feet wide and twenty (20) feet deep, together with properly related access to a street and maneuvering room. For purposes of rough computation, an "off-street parking space" and necessary access and maneuvering room may be estimated at three hundred (300) square feet, but off-street parking requirements will be considered to be met only when actual spaces meeting the requirements above are provided and maintained, improved in a manner appropriate to the circumstances of the case and in accordance with the requirements of this Part 1 and all ordinances and regulations of this township
OVERSIZED VEHICLE - A truck or other vehicle having either a total combined gross weight of vehicle plus load in excess of thirteen (13) tons or an extreme overall length in excess of twenty-three (23) feet, or both
PLANNED COMMERCIAL DEVELOPMENT . Development on a tract of at least forty (40) acres but not more than fifty (50) acres, which shall be developed and used according to a plan as a single entity, containing as its principal use one (1) or more shopping villages with appurtenant common areas to accommodate, as principal uses, only the principal uses described in § 100-74A through F hereof, and required common open space [Added 4-21-1993 by Ord. No. 1993-4]
PLANNING BOARD OR BOARD OF ADJUSTMENT The proper municipal agency, be it the Planning Board or Board of Adjustment, to review or approve the particular application for development involved, pursuant to the Municipal Land Use Law and the Holland Township Development Regulations Ordinance (1977), notwithstanding the actual wording of this Part 1.
PRINCIPAL BUILDING OR STRUCTURE - A building or structure primarily devoted to a principal use.
PRINCIPAL USE - A main use, a use which is not incidental or subordinate to another use on the same lot
SENIOR CITIZENS APARTMENTS WITH SUPPORTIVE SERVICES - Separate dwelling units reserved for occupancy be persons 62 years of age or older, which dwelling units may be located within one or more buildings, each containing a minimum of twenty (20) similar units, or in the same building(s) with assisted living units, wherein common facilities and a range of supportive personal and/or medical care services may be provided. Senior citizens apartments with supportive services may have access to and the use of congregate dining, laundry and social facilities, provided each such dwelling unit has its own separate complete kitchen and full bath, a door that is lockable from the inside and at least 300 square feet of clear floor area within the confines of the dwelling unit itself.

SETBACK LINE - A line within any lot, parallel to any street lines and measured perpendicularly from the street line, within which no building or part thereof may be erected except as provided in this Part 1. [Amended 9-15-1987 by Ord. No. 1987-9]
SHOPPING VILLAGE - Two (2) or more attached or detached retail commercial and/or office buildings, constructed on a lot and sharing common parking, loading areas and open space, and having as a principal use one (1) or more uses described in § 100-74A through F hereof [Added 4-21-1993 by Ord. No. 1993-4]
SIGN - Any device designed to inform or attract the attention of persons not on the premises on which the sign is located, provided, however, that the following shall not be included in the application of the regulations herein
A.Signs not exceeding one (1) square foot in area and bearing only property numbers, postbox numbers, names of occupants of premises or other identification of premises not having commercial connotations
B. Flags and insignia of any government except when displayed in connection with commercial promotion
C. Legal notices identification, informational or directional signs erected or required by governmental bodies
D.Integral decorative or architectural features of buildings, except letters, trademarks, moving parts or moving lights
SPECIAL EXCEPTION, SPECIAL EXCEPTION USE OR SPECIAL EXCEPTION USE PERMIT - Conditional use or conditional use permit pursuant to the Municipal Land Use Law and the Holland Township Development Regulations Ordinance (1977), notwithstanding the actual wording of this Part 1.4
STREET - Any street, avenue, boulevard, road, parkway, viaduct, drive or other way which is an existing state, county or municipal roadway, or which is shown upon a plat heretofore approved pursuant to law, or which is approved by official action as provided by the Municipal Land Use Law, or which is shown on a plat duly filed and recorded in the Hunterdon County Clerk's office prior to the appointment of a Planning Board for the township and the grant to such Board of the power to review plats, and includes the land between the street lines, whether improved or unimproved, and may comprise pavement, shoulders, gutters, curbs, sidewalks, parking areas and other areas within the street lines
STREET LINE - The dividing line between the lot and the street, or the street right-of-way line running across the lot where the lot extends into the street
STRUCTURE - Anything constructed or erected with a fixed location on the ground or attached to something having a fixed location on the ground Among other things, "structures" include buildings, swimming pools, mobile homes, billboards and poster panels, but shall exclude fences, posts, wires and their supporting poles or frames of electric or telephone utilities or other service facilities and school-bus waiting shelters whose location and design have been approved before erection by the Board of Education of the Township of Holland The word "structure' includes "buildings "
TRACT - An area of land composed of one (1) or more lots adjacent to one another, having sufficient dimensions and area in the aggregate to make one (1) integral parcel of land meeting the requirements of this Part 1 for the use(s) intended. With respect to a planned commercial development, the term "tract" shall refer to the whole of land area constituting the planned commercial development, having an area within the parameters referred to in the definition of planned commercial development [Added 4-21-1993 by Ord. No. 1993-4]
TRACTOR AND TRAILER - (As defined in said Title 39j shall be considered as separate vehicles unless they are joined to one another
USE - The purpose for which land or a structure thereon is designed, arranged or intended or for which it is or may be occupied or maintained.
YARD - A required open space unoccupied and unobstructed by any structure or portion of a structure from thirty (30) inches above the general ground level of the graded lot upward, except as otherwise permitted by this Part 1, provided, however, that fences, walls, poles, posts and other customary yard accessories, ornaments and furniture may be permitted in any yard subject to height limitations and requirements limiting obstruction of visibility
YARD, FRONT - A yard extending between side lot lines across the front of a lot adjoining a street
YARD, REAR - A yard extending across the rear of the lot between inner side yard lines
YARD, SIDE - A yard extending from the rear line of the required front yard to the rear lot line or, in the absence of any clearly defined rear lot line, to the point on the lot farthest from the intersection of the lot line involved with the street
ANTENNA - Any exterior transmitting or receiving device mounted on a tower, building or structure and used in communications that radiate or capture electromagnetic waves, digital signals, analog signals, radio frequencies (excluding radar signals), wireless telecommunications signals or other communications signals.
APPROVING AUTHORITY - The Planning Board with respect to conditional use permits, Zoning Board of Adjustment with respect to variance requests pursuant to N.J.S.A. 40:55D-70d(l) and (3), or the Zoning Officer for permitted uses with respect to this section and applicable Township Code provisions, as well as applicable state and federal law.
BACKHAUL NETWORK - The lines that connect a provider's tower/cell sites to one or more cellular telephone switching offices and/or long distance providers or the public switched telephone network.
FAA - The Federal Aviation Administration.
FCC - The Federal Communications Commission.
HEIGHT - When referring to a tower or other structure, the distance measured from the lowest finished grade of the base of the tower to the highest point on the tower or other structure, including the base pad and any antenna.
PREEXISTING TOWERS AND PREEXISTING ANTENNAS - Any tower or antenna for which a construction permit or other permit has been properly issued prior to the effective date of this section including permitted towers or antennas that have not yet been constructed, so long as such approval is current and not expired, and including any tower or antenna that is presently a permitted use pursuant to the Township Code on property owned, leased or otherwise controlled by the Township of Holland.
STEALTH TOWER STRUCTURE - Man-made trees, clock towers, bell steeples, light poles and similar altemative-design mounting structures that camouflage or conceal the presence of antennas or towers.
TOWER - Any structure that is designed and constructed primarily for the purpose of supporting one or more antennas for telephone, radio and similar communication purposes, including self-supporting lattice towers or monopole towers. Guyed towers are not permitted within the Township. The term includes radio and television transmission towers, microwave towers, common-carrier towers, cellular telephone towers, alternative tower structures and the like. The term includes the structure and any support thereto.
APPEAL means a request for a review of the Development Regulation Officer's interpretation of any provision of this ordinance or a request for a variance.
AREA OF SHALLOW FLOODING means a designated AO, AH, or VO zone on a community's Flood Insurance Rate Map with a one percent or greater chance of flooding to an average depth of one to three feet where a clearly defined channel does not exist, where the path of flooding is unpredictable and where velocity flow may be evident.
AREA OF SPECIAL FLOOD HAZARD means the land in the flood plain within a community subject to a one percent or greater chance of flooding in any given year.
BASE FLOOD means the flood having a one percent chance of being equaled or exceeded in any given year.
BASEMENT means any area of the building having its floor below ground level on all sides.
BREAKAWAY WALL means a wall that is part of the structural support of the building and is intended through its design and construction to collapse under specific lateral loading forces without causing damage to the elevated portion of the building or supporting foundation system.
DEVELOPMENT means any man made change to improved or unimproved real estate, including but not limited to buildings or other structures, mining, dredging, filling, grading, paving, excavation or drilling operations, or storage of equipment or materials located within the area of special flood hazard.
ELEVATED BUILDING means a non-basement building (i) built with the top of the elevated floor above the ground level by means of piling, columns (posts and piers) , or shear walls parallel to the flow of the water, and (ii) adequately anchored so as not to impair the structural integrity of the building during a flood up to the magnitude of the base flood. "Elevated building" also includes a building elevated by means of fill or solid foundation perimeter walls with openings sufficient to facilitate the unimpeded movement of flood waters.
FLOOD OR FLOODING means a general and temporary condition of partial or complete inundation of normally dry land areas from:
[1] The overflow of streams or rivers; or
[2] The unusual and rapid accumulation or runoff of surface waters from any source.
FLOOD INSURANCE RATE MAP (FIRM) means the official map on which the Federal Insurance Administration has delineated both the areas of special flood hazards and the risk premium zones applicable to the community.
FLOOD INSURANCE STUDY (FIS) means the official report in which the Federal Insurance Administration has provided flood profiles, as well as the Flood Boundary/Floodway Map and the water surface elevation of the base flood.
FLOOD PLAIN MANAGEMENT REGULATIONS means zoning ordinances, subdivision regulations, building codes, health regulations, special purpose ordinances (such as a flood plain ordinance, grading ordinance and erosion control ordinance) and other applications of police power. The term describes such State or local regulations, in any combination thereof, which provide standards for the purpose of flood damage prevention and reduction.
FLOODWAY means the channel of a river or other watercourse and the adjacent land areas that must be reserved in order to discharge the base flood without cumulatively increasing the water surface elevation more than 0.2 foot.
HISTORIC STRUCTURE means any structure that is:
[1] Listed individually in the National Register of Historic Places (a listing maintained by the Department of Interior) or preliminarily determined by the Secretary of the Interior as meeting the requirements for individual listing on the National Register;
[2] Certified or preliminarily determined by the Secretary of the Interior as contributing to the historical significance of a registered historic district preliminarily determined by the Secretary to qualify as a registered historic district;
[3] Individually listed on a State inventory of historic places in States with historic preservation programs which have been approved by the Secretary of the Interior; or
[4] Individually listed on a local inventory of historic places in communities with historic preservation programs that have been certified either:
(a) By an approved State program as determined by the Secretary of the Interior; or
(b) Directly by the Secretary of the Interior in States without approved programs.
LOWEST FLOOR means the lowest floor of the lowest enclosed area [including basement]. An unfinished or flood resistant enclosure, useable solely for the parking of vehicles, building access or storage in an area other than a basement is not considered a buildings lowest floor provided that such enclosure is not built so to render the structure in violation of other applicable non-elevation design requirements.
MANUFACTURED HOME means a structure, transportable in one or more sections, which is built on a permanent chassis and is designed for use with or without a permanent foundation when attached to the required utilities. The term "manufactured home" does not include a "recreation vehicle".
MANUFACTURED HOME PARK OR MANUFACTURED HOME SUBDIVISION means a parcel (or contiguous parcels) of land divided into two or more manufactured home lots for rent or sale.
NEW CONSTRUCTION means structures for which the start of construction commenced on or after the effective date of a floodplain regulation adopted by a community and includes any subsequent improvements to such structures.
NEW MANUFACTURED HOME PARK OR SUBDIVISION means a manufactured home park or subdivision for which the construction of facilities for servicing the lots on which the manufactured homes are to be affixed (including at a minimum, the installation of utilities, the construction of streets, and either final site grading or the pouring of concrete pads) is completed on or after the effective date of the flood plain management regulations adopted by the municipality.
RECREATIONAL VEHICLE means a vehicle which is [i] built on a single chassis; [ii] 400 square feet or less when measured at the longest horizontal projections; [iii] designed to be self-propelled or permanently towable by a light duty truck; and [iv] designed primarily not for use as a permanent dwelling but as temporary living quarters for recreational, camping, travel, or seasonal use.
START OF CONSTRUCTION includes substantial improvements and means the date the building permit was issued, provided the actual start of construction, repair, reconstruction, rehabilitation, addition, placement, or other improvement was within 180 days of the permit date. The actual start means either the first placement of permanent construction of a structure on a site such as the pouring of a slab or footings, the installation of piles, the construction of columns, or any work beyond the stage of excavation, or the placement of a manufactured home on a foundation. Permanent construction does not include land preparation, such as clearing, grading and filling nor does it include the installation of streets and/or walkways, nor does it include excavation for a basement, footings or piers, or foundations or the erection of temporary forms, nor does it include the installation on the property of accessory buildings, such as garages or sheds not occupied as dwelling units or not part of the main structure. For a substantial improvement, the actual start of construction means the first alteration of any wall, ceiling, floor, or other structural part of a building, whether or not that alteration affects the external dimensions of the building.
STRUCTURE means a walled and roofed building, a manufactured home, or a gas or liquid storage tank, that is principally above ground.
SUBSTANTIAL DAMAGE means damage of any origin sustained by a structure whereby the cost of restoring the structure to its before damaged condition would equal or exceed 50 percent of the market value of the structure before the damage occurred.
SUBSTANTIAL IMPROVEMENT means any reconstruction, rehabilitation, addition, or other improvement of a structure, the cost of which exceeds 50 percent of the equalized assessed value of the structure before the "start of construction" of the improvement. This term includes structures which have incurred "substantial damage", regardless of the actual repair work performed. The term does not, however, include either:
[1] Any project for improvement of a structure to correct existing violations of State or local health, sanitary or safety code specifications which have been identified by the local code enforcement officer and which are the minimum necessary to assure safe living conditions; or
[2] Any aiteration of a "historic structure", provided that the alteration will not preclude the structure's continued designation as a "historic structure".
VARIANCE means a grant of relief from the requirements of this ordinance which permits construction in a manner that would otherwise be prohibited by this ordinance.
APPROVING AUTHORITY - The Township Planning Board, unless a different municipal agency is designated in the text of this Part 2 or has the power of review, approval or other action, when acting pursuant to the authority of the Municipal Land Use Law, in which case it shall be that municipal agency.
BOARD OF ADJUSTMENT - The Holland Township Board of Adjustment
BUFFER STRIP - A strip of land, of the width designated by this Part 2, maintained in trees or other natural woodland growth, or planted with evergreens, hedge or shrubbery of sufficient height to protect adjoining residential, agricultural, industrial or commercial uses from noises, dust, glare or other possible nuisances which might result from the operation of mining, utility, storage, commercial or loading or parking activities
BUILDING CODE - The New Jersey State Uniform Construction Code"
BUILDING PERMIT - The construction permit required under the New Jersey State Uniform Construction Code for new construction, renovation, alterations or additions, or a combination thereof
CONDITIONAL USE - A use permitted in a particular zoning district only upon a showing that such use in a specific location will comply with the conditions and standards for the location or operation of such use as contained in the zoning provisions of this Part 2 and upon the issuance of an authorization therefor by the approving authority
DISTRICT - A zoning district

ENVIRONMENTAL COMMISSION - The Environmental Commission established by ordinance of the township
FLOOD FRINGE - That portion of the flood hazard area outside of the floodway
FLOOD HAZARD AREA - The floodway and any additional portions of the floodplain which the improper development and general use of would constitute a threat to the safety, health and general welfare. This shall constitute the total area inundated by the flood hazard design flood
FLOODPLAIN - The relatively fiat area adjoining the channel of a natural stream, which has been or may be hereafter covered by floodwater
FLOODWAY - The channel of a natural stream and portions of the floodplain adjoining the channel which are reasonably required to carry and discharge the floodwater or flood flow of any natural stream This shall constitute the portions of the floodplain needed for the passage of the floodway design flood without an appreciable rise in the water surface profile
GOVERNING BODY - The Township Committee of the township
LOT - A designated parcel or area of land established by plat or otherwise established by deed description, subdivision or record of survey map and to be used, developed or built upon as a unit
MAINTENANCE GUARANTY - Any security, other than cash, which may be accepted by the township for maintenance of any improvements required by this Part 2.
MAJOR DEVELOPMENT - A development requiring major subdivision or site plan approval.
MAP FILING LAW - N.J.S.A. 46-23-9.9 et seq.
MINOR SUBDIVISION [Amended 4-15-80 by Ord. No. 506]:
A. A subdivision of land that does not involve:
(1) The creation of more than three (3) lots, including any lot consisting of the remainder of the original lot
(2) Planned development as defined in the Municipal Land Use Law,"
(3) Any new street, or
(4) Extension of any off-tract improvement, the cost of which is to be prorated pursuant to § 100-180 of this Part 2 If the lot or lots have once been part of a minor subdivision under this Part 2 or any ordinance repealed hereby, a further division thereof shall not be classified as minor if the granting of the required minor subdivision(s) would result in more than three (3) minor subdivision lots, including the remainder of the original lot, being created within a twelve-month period
MUNICIPAL ATTORNEY OR ENGINEER - The attorney or engineer of the township
MUNICIPAL LAND USE LAW - N.J.S.A. 40-55D-1 et seq.
OFF-SITE AND OFF-TRACT IMPROVEMENTS - Improvements outside the site in question or the tract in question, respectively, to accommodate conditions generated inside the original tract as the result of the proposed development which shall include, but not be limited to, installation of new improvements and extensions and modification of existing improvements
OWNER - An individual, firm, association, syndicate, copartnership or corporation having sufficient proprietary interest in the land sought to be subdivided to commence and maintain proceedings to subdivide the same under this Part 2
PLANNING BOARD - The Holland Township Planning Board
RIGHT-OF-WAY - The total width and length of the course of a street
SITE PLAN EXEMPT - Development which does not comprise, in whole or in part, a use as to which a site plan is required under § 100-35, 100-54, 100-73 or 100-91 of the Zoning Ordinance. [Amended 9-6-77; 4-4-84 by Ord No. 84-3]
SITE PLAN, MAJOR - All site plans not defined as minor or exempt
SITE PLAN, MINOR - A site plan for a development requiring less than ten (10) parking and/or loading spaces as required in this Part 2, containing less than two thousand five hundred (2,500) square feet of floor area, not having more than fifty-percent lot coverage, not involving any planned development, not involving any new street not involving the extension of any off-tract improvement which is to be prorated pursuant to N.J.S.A. 40:55-42, and contains information reasonably required to make an informed determination as to whether the requirements established by this Part 2 for approval of a minor site plan have been met. SITE PLAN REVIEW ADVISORY BOARD - A group of citizens appointed by the Mayor for the purpose of reviewing site plans referred to it by the approving authority and making recommendations to the approving authority.
SILTATION BASIN - A facility through which stormwater is directed and which is designated to collect eroded soil from a designated area.
STREET :
A. Any street avenue, boulevard, road, parkway, viaduct, drive or other way which is an existing state, county or municipal roadway; shown upon a plat heretofore approved pursuant to law-, approved by official action as provided in this Part 2; or shown on a plat duly filed and recorded in the office of the County Recording Officer prior to appointment of a Planning Board and the grant to such Board of the power to review plats; and includes the land between the street lines, whether improved or unimproved, and may comprise pavement, shoulders, gutters, curbs, sidewalks, parking areas and other areas with the street line [Amended 9-6-77]
B.The balance of said definition of "street' shall continued to read as heretofore.
C.For the purposes of this Part 2, "streets" shall be classified as follows.
(1) ARTERIAL STREETS - Those which are used primarily for fast or heavy traffic(2) COLLECTOR STREETS - Those which carry traffic from minor streets to the major system of arterial streets, including the principal entrance streets of a residential development and streets for circulation within such a development,
(3) MINOR STREETS - Those which are used primarily for access to the abutting properties
(4) MARGINAL ACCESS STREETS - Streets which are parallel to and Ascent to arterial streets and highways and which provide access to abutting properties and protection from through traffic.
(5) ALLEYS - Minor ways are used primarily for vehicular service access to the back or the side of properties otherwise abutting on a street
TOWNSHIP - The Township of Holland, in the County of Hunterdon, New Jersey.
TRACT - An area of land composed of the lot or lots which are the subject of the development application as well as all property (of which such lot or lots are a part) contiguous thereto and in the same ownership, and also all portions of a street or right-of-way contiguous to such lot(s) or other property.
ZONING DISTRICT - A zoning district established under the Zoning Ordinance
ZONING ORDINANCE - The applicable Zoning Ordinance of the township, as amended and supplemented.
ZONING PERMIT - The zoning permit required under the Zoning Ordinance
APPLICANT - Any person applying for site plan approval, subdivision approval or a construction permit for development, all or part of which is in the township
DRAINAGEWAY - Any watercourse, trench, ditch, depression, etc, natural or artificial, which collects or disperses surface water from the land,
DETENTION BASIN - A floodwater control device which detains a portion of the total runoff
HYDROGRAPH - A graph showing for a given point in the drainage system the peak flows versus time during the design storm.
RECHARGE DEVICES - Devices such as dry wells, cisterns, etc, which collect stormwater and recharge this water to the ground via percolation through the soil
RETENTION BASIN - A floodwater control device which retains a certain portion of the runoff and detains an additional amount during subsequent storms
TOWNSHIP - The Township of Holland, in the County of Hunterdon, State of New Jersey
WATERSHED - That total land area which drains to a given point along a drainageway
