Any person who violates any provision of this chapter shall, upon conviction thereof, be subject to a fine of not more than $500 or to imprisonment in the county jail for a term not exceeding 30 days, or both such fine and imprisonment, in the discretion of the court. Any willful failure by an applicant to comply with and satisfy conditions of subdivision or site plan approvals as established by a memorializing Resolution adopted by the Land Use Board or undertaking construction of the improvements which are the subject of the approved subdivision or site plan not in compliance with the plans approved by the Land Use Board or not operating the approved use in compliance with the approval, including the terms and conditions of such approved memorializing Resolution, shall be deemed a violation and shall result is imposition of the penalties provided for herein. Additionally, violation of the provisions of Section 245-17 hereinabove, which provisions are deemed to be complimentary, not mutually exclusive, to the provisions of this section, shall also be deemed to constitute a violation and shall result in imposition of the penalties as set forth hereinabove.
