ARTICLE VI R-3 Residential Medium-Density District (Special)

�197-39. Permitted uses.

The following uses are permitted in the R-3 District:

A. Single-family detached dwelling used as a residence by not more than one family, provided that there shall be not more than one house on any lot.

B. Public park or public recreation area.

C. Public and private utility structures necessary to serve areas within the. borough. Utility structures which resemble substations or industrial-type facilities are prohibited.

D. A place of worship, parish house, Sunday school or convent.

E. Two-family dwelling unit.

�197-40. Prohibited uses.

Any use other than those listed in �197-39 is prohibited.

�197-41. Permitted accessory uses.

The following accessory uses are permitted in the R-3 District:

A. A private school with use limited to no more than six people.

B. Family day-care or exempt child-care centers subject to applicable New Jersey Division of Youth and Family Services requirements, but limited to no more than five children.

�197-42. Accessory buildings.

The following accessory buildings are permitted in the R-3 District:

A. A private garage for the storage of not more than three motor vehicles.

B. A shed, either temporary or permanent, subject to the following regulations:

(1) The maximum size shall be 10 feet by 10 feet.

(2) They shall be located at least three feet from any lot line.

(3) They shall be permitted only in the rear yard of a lot with a principal building.

�197-43. Lot requirements.

A. The building lot shall have an area of not less than 5,000 square feet.

B. The building lot shall have frontage of not less than 50 feet.

C. The front yard shall be not less than twenty-five (25) feet on the ground floor and a second floor shall not be less than twenty-three (23) feet, with the exception of corner lots which shall have on the first floors which shall have a front yard abutting the shortest street line so as not to interfere with line of sight for motor vehicles.

D. The building lot shall have side yards of not less than five feet.Further, in the case of any two-family dwelling unit, as defined by this bode, and as permitted in the R-3 Zone, the side yards shall each-be a minimum of 10% of the greater of the lot width as measured at the front property line and at the 25-foot front set-back line, so that the combined side-yard setbacks shall be a minimum of 20% of such lot width.

E. Corner lots shall have a front yard abutting the shortest street line.

F. The building lot shall have a rear yard of not less than 20 feet.
