ARTICLE V Appeals [Amended 8-23-1995 by Ord. No.95- 17]

§30-33. Appeals to Planning Board.

Any interested party affected by any decision of an administrative officer of the municipality, based on or made in the enforcement of the zoning ordinance, or official may appeal such decision or determination to the Planning Board pursuant to N.J.S.A. 40:55D-25c and N.J.S.A. 40:55D-72. Such appeal shall be taken within twenty (20) days of receipt of the administrative officers decision by filing a notice of appeal with such administrative officer. The officer shall immediately transmit to the Board a copy of the notice of appeal, together with all papers constituting the record upon which the action appealed from was taken. All decisions of the Board shall be rendered in accordance with the procedure set forth in N.J.S.A. 40:55D-73.

§30-34. Appeals to governing body; procedure.

Any interested party may appeal to the governing body a final decision of the Planning Board approving an application for development pursuant to Subsection d of N.J.S.A. 40:55D-70. Such appeal shall be made within ten (10) days of the date of publication of such final decision pursuant to -Subsection i of N.J.S.A. 40:55D-10. The appeal to the governing body shall be made by serving the Borough Clerk, in person or by certified mail, with a notice of appeal. 'The notice shall specify the grounds for the appeal, the name and address of the appellant and the name and address of his or her attorney, if represented. Such appeal shall be decided by the governing body only upon the record established before the board and in accordance with the procedures set forth in Subsections b through h of N.J.S.A. 40:55D-17.
