20-8.3 Off-Street Parking Design Standards.

a. Surface material. All driveways and off-street parking lots in residential, commercial, M-1 or H-S districts with a capacity of four or more vehicles shall be surfaced with asphaltic or oil penetration surface material so as to be hard surfaced and dust free.

b. Curbing. All off-street parking space in C, M-1 or H-S districts shall be provided with curbing or the equivalent so that vehicles cannot drive into required landscape areas.

c. Screen planting/fence. Screen planting of a dense evergreen material no less than four feet or more than six feet in height shall be provided in any location where lights from vehicles within the off-street parking area may shine directly into windows of adjacent residential buildings.

In lieu of screen planting, a wooden fence or woven lattice or louver type or split cedar fence with a maximum of three-quarter inch spacing may be provided no less than four feet nor more than six feet in height.

d . Entrance/exit. In any commercial, H-S or M-1 district, all Off-street parking areas in front of a building or place of business, or in an area contiguous to a public street, shall be provided with one entrance and one exit for vehicles, each 12 feet in width, or a combination entrance and exit at least 25 feet in width. Curbing shall be constructed or erected on the established curbline along the abutting streets at all points other than at the required vehicular openings.

e. Parking space size. The minimum area for parking of a motor vehicle shall be one hundred eighty (180) square feet.

f. Front yard parking. Off-street parking is prohibited in the front yards of any single family, detached or duplex residential dwellings.

20-8.4 Parking Development Requirements in C-1 District.

a. All driveways and off-street parking spaces provided for professional and office uses shall be surfaced with asphaltic or oil penetration surface material so as to be hard-surfaced and dust free.

b. All off-street parking spaces shall be provided with curbing or the equivalent so that vehicles cannot drive into required landscape areas.

c. Screen planting of a dense evergreen material no less than four feet or more than six feet in height shall be provided in any location where lights from vehicles within the off-street parking area may shine directly into windows of adjacent residential buildings.

d. In lieu of screen planting, a wooden fence or woven lattice or louver type or split cedar fence with a maximum of three-quarter inch spacing may be provided no less than four feet nor more than six feet in height.

20- 8.5 Off-Street Loading.

Off-street loading area or berths, open or enclosed with proper access from a street, highway, common service driveway or alley shall be provided for any use specified herein. In addition, such spaces shall comply with the design standards for such spaces as contained herein.

Any land which is developed as a unit under single ownership and control shall be considered a single lot for the purpose of these loading requirements.

20-8.6 Schedule of Off-Street Loading Requirements.

Each business use shall provide off-street loading space at the side or rear of the building at the rate of one space, ten feet by 25 feet with adequate ingress and egress, for each 5,000 square feet of floor area or fraction thereof in each building.

20-8.7 Parking and Loading Space Requirements.

a. Fractional space. When the application of a unit of measurement for parking space or loading space to a particular use or structure results in a fractional space, a space shall be required for each such fraction.

b . Computed number of employees. The number of employees, where not clearly stipulated, shall be computed on the basis of persons to be employed, taking into consideration day, night and seasonal variations.

c. Minimum space requirements for uses not specifically covered. In determining minimum parking space requirements for uses not covered by this Article, the planning board shall be guided by the number of persons to be employed in said building or by the use; the number of persons expected to reside in, visit, or patronize the building or use; the anticipated percentage of residents, visitors, or patrons using various transportation modes; and the need for safe and convenient loading space for visitors or patrons and goods.

d. Front yard parking. For single family detached or duplex dwellings, parking in the required front yard area of the lot shall be prohibited.



20-8.8 Supplementary Requirements for Parking and Off-Street Loading.

a. CBD Parking (C-2 District).

For business uses: one space per number of employees estimated to be working at any one time, plus one space per 350 square feet of floor selling area of the building.

1. Upon application, the planning board may permit parking spaces in any town parking lot or any parking lot owned and operated by the parking authority of the town or any privately owned public parking lot to be counted in whole or in part, in lieu of all or part of the number of off- street parking spaces required under paragraph 2 herein. The planning board, in making such determination, shall be guided by the following factors:

1. The volume of sales and turnover of customers which might reasonably be expected for the type of business use in question.

ii. The availability of land for additional off-street parking, and whether from the standpoint of sound planning such land is best suited for the purpose or should be reserved for uses other than off-street parking.

iii. The capacity of available off-street parking lots in the area involved and the likely effect upon such facilities of the proposed business use.

iv. Future plans for development of off-street parking facilities by the town and the parking authority of the town or other public agency and such other facility as may be deemed applicable by the planning board.

2. Prior to making a determination whether existing off-street parking facilities may be counted, in whole or in part, in lieu of meeting the requirements of paragraph a herein, in any case, the planning board shall consult with the parking authority of the town, town officials, or the private owners or operators of public parking lots to obtain information concerning factors such as capacity of lots, peak loads, normal loads, trends as to use of such facilities and such other information as the planning board may deem necessary. Any information so required, if considered in making a determination, shall be made available to the applicant and shall be recited in the resolution of determination required to be adopted pursuant to paragraph 3 herein.

3. Whenever application has been made by any person for permission to use existing off-street public parking facilities in lieu of the strict compliance with the requirements of paragraph a herein, the determination of the planning board, either granting or denying such application, shall be embodied in a resolution adopted by the board. Such resolution shall contain a brief statement of the board's finding of facts and the factors in arriving at its decision.

b. Waiver of Parking and Off-street Loading and Unloading Requirements.

1. Excess spaces. Where it can be demonstrated, at the time of planning board review, that the parking and/or loading and unloading requirements of this Article will result in more parking spaces than actual needs require, the planning board may either (a) permit a portion of the proposed parking and/or loading areas to remain unpaved, but landscaped and improved only with a six (6) inch base course of one and one-half (I 1/2) inch crushed stone stabilized with topsoil and seeded to lessen storm water runoff. Such unpaved area shall remain reserved for such future facilities needs and, if conditions in use or actual operation of the proposed use vary, the planning board may require such unpaved space to be paved; or (b) reduce the number of required spaces based on adequate documentations that a particular use will not require the ordinance stipulated number of spaces.

2. Exceeding minimum off-street parking and loading requirements. Minimum off-street parking and loading requirements as required by this Article may only be exceeded, where it can be demonstrated, at the time of planning board review, that such additional parking facilities are necessary for the actual operation of a proposed use. In such instances, the planning board may grant an increase in minimum space on a lot provided that all other bulk and area requirements are met for the use in the district in which it is located.
