ARTICLE XXXII APRD-2 Alternative Planned Residential Development 2 District

§ 430-226. Purpose.

The preamble of this article is incorporated herein, and the purpose in creating the APRD-2 Alternative Planned Residential Development 2 Zone is to encourage the development of large tracts of land for residential use and to promote contributions to regional contribution agreements to provide construction of housing for low-income and moderate-income persons.

§ 430-227. Permitted uses.

The following uses shall be permitted:

A. Single-family detached houses.

B. Townhouse development. A "townhouse development," for purposes of this section, shall mean a townhouse residential cluster developed as a single entity in which individual lots have a common or public open space as an appurtenance.

C. The total development of the property shall not exceed 360 dwelling units consisting of up to 166 single-family dwelling units and the remainder shall be townhouse units.

§ 430-228. Accessory uses.

Accessory uses usually incidental to the above uses shall be permitted, including, but not limited to, those specified below:

A. Noncommercial swimming pools for the exclusive use of the site's residents only.

B. Noncommercial recreational uses, including a clubhouse with food and beverage service facilities, tennis courts and health club facilities for the exclusive use of site residents and their guests.

C. Security structures, such as a guardhouse.

§ 430-229. Development regulations.

A. Unless it is part of a townhouse development, single-family detached housing shall comply with the minimum development requirements for R-3A (RCA) Zone, § 430-68, except as provided hereinbelow:

(1) Lot width shall be measured along a parallel line to the street line connecting the points of intersection of the side lines of the lot.

(2) In the case of corner lots, the front yard depth shall be no less than 20 feet.

(3) In addition to permitted projections into yard area, as provided by § 430-10F, a deck shall be permitted, but shall not extend more than 14 feet into the required rear yard.

B. Townhouse developments shall comply with the following minimum standards:

(1) The minimum building setback distance of any residential structure shall be 50 feet from existing federal and state roads and any road classified as other than a local street as designated upon the Transportation Plan of Parsippany-Troy Hills, dated May 26, 1976.

(2) The minimum front setback from all other public streets shall be 20 feet.

(3) Buffer requirements. There shall be established along any boundary of any tract which coincides with a public road a minimum buffer width of 40 feet. The buffer area shall contain no building or other impervious coverage except as provided in § 430-10 but may contain a decorative wall, fence or other similar features to enhance the integrity of the buffer.

(4) The minimum width of any townhouse structure shall be 20 feet; the maximum length of any townhouse structure shall be 200 feet.

(5) The maximum building height shall be 35 feet.

(6) The minimum number of units per structure shall be one.

(7) The maximum number of units per structure shall be eight.

(8) The minimum distance between townhouse structures shall be 25 feet.

(9) The minimum setback from an adjoining property which is not a part of the townhouse development shall be 25 feet except that each townhouse unit may be provided with a patio or deck which may extend a maximum of 12 feet from the rear wall of the townhouse structure and be within a required yard or buffer area.

(10) Each townhouse unit shall be required to have a one-car garage and connecting driveway. The minimum parking standards as set forth in the New Jersey Residential Site Improvement Standards shall apply. Any such additional parking spaces shall be provided by on-street parking.

§ 430-230. Additional standards.

A. Streets, utilities and other public facilities. The authority granted to the Planning Board and the Township of Parsippany-Troy Hills to establish standards for the location, width, course and surfacing of public streets and highways, sidewalks, streetlights, stormwater drainage, water supply and distribution, sanitary sewers and sewage collection and treatment shall be vested in the Planning Board for the purpose of this section. The Planning Board is hereby authorized to make such modifications of standards and requirements otherwise required of subdivisions and site plans as set forth in Chapter 225, Land Use, Subdivisions and Site Plans, of the Township of Parsippany-Troy Hills, as long as such modifications are consistent with the terms of this article, except that the following minimum standards shall apply:

(1) Streets.

(a) Public streets shall have a right-of-way width of 50 feet and a paved width of 28 feet. Internal private roads servicing two-way traffic shall have a right-of-way width of 30 feet and a paved width of 28 feet. On-street parking shall be permitted on one side of all streets.

(b) Sidewalks shall be at least three feet in width.

(c) Serviceways for public service and emergency vehicles shall be no less than 15 feet in width.

(2) All electric, gas and telephone utility lines shall be installed underground. Prior to the issuance of a building permit, written certification from each serving utility shall be required which shall evidence full compliance with the provisions of this requirement.

(3) Common or shared driveways shall be permitted.

(4) Refuse and recyclable collection shall be curbside pickup.

§ 430-231. Signs.

Signs shall be permitted, subject to the sign regulations of Article XXXVIII, in the manner set forth in § 430-286.
