A. For the purpose of this Part 9, the Township of Boonton is hereby subdivided into 11 zone districts known as:
R-261 Residence District
R-81 Residence District
R-40 Residence District
R-30 Residence District
R-20 Residence District
R-1 A Residence District
R-1 B Residence District
R-ASH Assisted Senior Housing District
OB Office Building District
RB Retail Business District
BP Business Park District
B. Portions of certain of the foregoing zone districts are further incorporated within flood hazard area zones, which are more specifically defined in the Flood Management Ordinance.

The map entitled, "Zoning Map, Township of Boonton, New Jersey," dated December 2005, which accompanies this chapter, is hereby declared to be part thereof.
The zone boundary lines shown on the Zoning Map are intended to coincide with property lines, the center lines of streets, railroads or drainage courses as they existed at the time of adoption of this chapter, or they are designated on the Zoning Map by figures or dimensions. In case of uncertainty as to the location of any zone boundary line, the determination thereof shall be by the Board of Adjustment.
The schedule entitled "Schedule D, Permitted Uses, Township of Boonton," which accompanies this chapter, is hereby declared to be part hereof.
The schedule entitled "Schedule E, Zoning Requirements, Township of Boonton," which accompanies this chapter, is hereby declared to be part hereof.
A. Except as otherwise provided herein, this article shall be enforced by an agent appointed by the Township Committee who shall be known as the "Zoning Officer," or his deputy. The Construction Official shall in no case issue a building permit for the erection or structural alteration of any building nor issue a certificate of occupancy for any building or use or change in use unless a zoning permit has been issued by the Zoning Officer as conforming to this Part 9 and other related ordinances and regulations of the Township. The Construction Official and the Zoning Officer may be one and the same individual.
B. No zoning permit shall be issued for the erection, construction, reconstruction, structural alteration or moving of any building or structure, or part thereof, unless the plans and intended use or change in use indicate that such building or structure is designed and intended to conform in all respects to the provisions of this Part 9.
C. The Zoning Officer shall revoke any zoning permit if he finds that actual conditions or construction does not adhere either to the plans or specifications submitted to him or to any other applicable municipal or state regulations.
D. The zoning permit shall specify the use of land or building and any circumstances or conditions imposed by any public agency, code or regulations. Any change in use, including a change from one permitted use to another kind or permitted use in the same zone, or any additional use, will be treated as a new use, and a new zoning permit shall be required. Prior to the issuance of a zoning permit for said change in use, all provisions of this Part 9 shall be complied with the same as if the new use were a new structure or a new use of land.
E. A record of all zoning permits shall be kept on file in the office of the Zoning Officer, and copies shall be furnished upon request to any person having a proprietary or leasehold interest in the building or land affected.
F. It shall be the further duty of the Zoning Officer to investigate any violations of this Part 9 coming to his attention, whether by complaint or arising from his own personal knowledge, and, if a violation is found to exist, he shall take such action as he deems appropriate in the circumstances.
