The Planning Board shall act upon any site plan provided for in § 102-118 within 60 days of the date of the filing of a completed application, or the date of approval by the State Department of Environmental Protection, whichever is later, or other extension of time agreed to by the applicant. Failure of the Planning Board to act within the time limit or limits as extended shall be deemed denial of an approval of any site plan submitted under this Part 7. Planning Board decisions shall include separate written findings of fact and reasons for granting or denying an application.

No building permit shall be issued by the Building Inspector for any proposed structure to be located within any floodplain area unless and until the Planning Board shall have approved a site plan submitted in accordance with § 102-19 of this chapter. Upon approval or denial of any site plan required by § 102-19 of this chapter, the Secretary of the Planning Board shall forthwith notify the Building Inspector thereof. No certificate of occupancy shall be issued by the Building Inspector unless and until proof has been submitted to him that all conditions of site plan approval have been fully met and complied with.

Any person, firm or corporation violating any provisions of this Part 7 shall be subject, upon conviction, to the penalties provided in § 1-15 of this Code.
