17.20.055 Redevelopment Zone

A. There is hereby created with The Borough of Glen Ridge a Redevelopment Zone, the initial metes and bounds description thereof being attached hereto as Exhibit A.

B. On and after the effective date hereof, uses formerly allowed by the former R - 5 zone shall continue to be allowed uses in the Redevelopment Zone.

17.20.060 Fences.

No fence or barrier exceeding four feet in height above finished grade shall be erected or maintained in any front yard and no fence or barrier exceeding seven feet in height above finished grade shall be erected or maintained in any rear or side yard. A permit shall be required for any fence or barrier over four feet in height except that no permit shall be required for any fence or barrier required by any ordinance and no permit shall be required for temporary construction fences or required for temporary construction fences or barriers. Any fence or barrier installed pursuant to a permit granted under this title shall be installed so that its finished surface faces the exterior perimeter of the property on which it is installed. 17.20.070 Community residences for the developmentally disabled.

A. The term "community residences for the developmentally disabled," as used in this chapter, shall have the same meaning as the term "community residence for the developmentally disabled" as defined in N.J.S.A. 40:55D-66.2.

B. Community residences for the developmentally disabled shall be a permitted use in all residential districts of the borough and the requirements therefor shall be the same as the requirements for sin-le family dwelling units located within the borough.

C. Notwithstanding the provisions of subsection B, in the case of a community residence for the developmentally disabled housing more than six persons, excluding resident staff, the use or a conversion of a dwelling unit to such a community residence shall be permitted only upon application to the planning board.

D. prior to permitting the use of any dwelling unit as or the conversion of any dwelling unit to a community residence for developmentally disabled, the planning board shall determine that such community residence shall comply with every state, county and local law, ordinance or code governing such residence, including but not limited to the Uniform Construction Code of New Jersey.

E. In addition, in order to provide for the health, safety and well-being of the residents of any such community residence and in order to provide for the health, safety and well-being of the other residents of the borough, the planning board shall insure that the requirements of subsections F and G shall be met.



F. Fire safety features in any such community residence must include:

1. In addition to interior stairwells, one fully enclosed means of egress from the building leading directly to grade and directly connected to each floor above grade that is utilized; exit to the egress shall not be permitted through any bedroom, and the corridor leading to the egress shall be at least thirty-six inches wide; the separation between the egress and the building should consist of a minimum one-hour fire-rated material;

2. A smoke separation between each floor utilizing, a one-hour fire-rated door equipped with an automatic closing device;

3. A comprehensive automated fire alarm and detection system with manual pull stations located at the front door and at the -exit to the enclosed means of egress on all floors above grade, if such floors are utilized;

4. Handrails provided in all stairwells;

5. Smoke detectors located as follows:

a. One unit in each bedroom,

b. One unit in each hallway on all floors,

c. One unit in the living room and/or all indoor recreational areas,

d. One unit at the top of every stairway,

e. One unit in the laundry room;

6. Thermal detectors located as follows:

a. One unit in the kitchen,

b. One unit in the furnace room,

c. Other special high risk areas;

7. Boiler or furnace rooms fully enclosed and separated from the living and common areas by a minimum one-hour fire rated material;

8. If boiler or furnace rooms are in the basement, a readily identifiable heater disconnect switch provided at the top of the stairs leading to the basement area;

9. If the boiler or furnace room is located on the first floor, a readily identifiable heater disconnect switch located outside of the room;

10. If the basement is to be used as an activity room:

a. An exit other than an interior stairwell to be provided,

b. The ceiling to be enclosed with five eighths-inch sheetrock or three-quarter-inch wire lathe and plaster,

c. The basement to be a warm, dry and adequately illuminated,

11. Exit areas not to be permitted through furnace are, storage areas or bedrooms;

12. The approved means of egress in case of fire not to be permitted through kitchens;

13. Doors used for exits to be unlocked from the inside of the building;

14. At least one ABC type fire extinguisher, with a minimum of a IA rating, to be mounted in the kitchen and outside the furnace room(s);

15. All floors to be provided with at least one ABC type fire extinguisher with a minimum of a 2A rating;

16. Space heaters, including but not limited to electrical, kerosene and quartz heaters, to be prohibited;

17. A fire evacuation plan to be posted on each floor in a prominent location;

18. Storage space or closets under any stairway to be permitted only if such spaces enclosed in a one-hour fire-rated material;

19. Nonskid surfaces, to reduce or prevent slipping, to be used on all stairs or where slippery surfaces present a hazard;

20. Every habitable room to have at least one operable window opening directly to the outside;

21. Windows to have an operable window space of 5.7 square feet;

22. A heating, system which is properly installed, maintained in good and safe working condition and capable of safely and adequately heating all habitable rooms and bathrooms to a temperature of at least seventy-four degrees Fahrenheit;

23. Combustible materials to be stored in noncombustible containers-,

24. Chimneys, flues and vent attachments to be structurally sound, free from defects and cleaned and maintained as necessary;



25. Fireplaces which are utilized to be equipped with a tempered glass enclosure;

26. Water heating systems installed and maintained in good and safe working conditions, connected with hot water lines, and capable of delivering water at the minimum temperature of not less than one hundred ten degrees Fahrenheit and at a maximum temperature of not more than one hundred sixty degrees Fahrenheit at all times with anticipated needs;

27. Electrical wiring and equipment to comply with local or municipal requirements and maintained in good operating condition; any new equipment and wiring must be installed by a licensed electrician and shall be in compliance with "The National Electrical Code/1978" (Electrical SubCode of the Uniform Construction Code, N.J.A.C. 5:23-3.6), including all subsequent revisions and amendments thereto.

G. For purposes of general safety and well-being:

1. Occupancy shall be limited to floors above grade; provided, however, sleeping quarters shall not be permitted for either staff or residents above the second floor in any residence and provided further that basement occupancy may be permitted for recreational uses;

2. Shower heads, taps, and valves shall be so equipped that the temperature of the water cannot exceed one hundred ten degrees Fahrenheit at any time;

3. All bathrooms shall include nonslip surfaces in the showers or bathtubs;

4. Every bathroom door lock shall be designed to permit the opening of the locked door from the outside in case of emergency;

5. Them shall be a minimum of seventy square feet per person in each bedroom; in bedrooms with slanted ceilings, the usable room size shall be determined by measuring from a point on the ceiling that is 5.5 feet from the floor to a point on the ceiling across the room that is also 5.5 feet from the floor', this area shall constitute usable floor space in determining the licensing capacity of the room;

6. There shall be a limit of two persons (of the same sex) to a bedroom;

7. Bedrooms shall not be a means of access to any other room;

8. Separate toilet facilities shall be provided for men and for women; there shall be at least one toilet and sink for every five occupants (or part thereof) of each sex. These facilities shall not be further than one floor from any living area. The sink shall be located in/or adjoining the toilet area;

9. There shall be at least one bathtub or shower for every five residents, not including staff,

10. A suitable living room, comfortably furnished, shall be provided to insure adequate seating for at least two-thirds of the design capacity of the home;

11. A dining room of sufficient size shall be provided and equipped to seat comfortably all residents and staff at one seating,

12. Kitchens shall be provided with either natural or mechanical ventilation at the stove area; four-burner stoves (normally used in homes) shall be ventilated by a mechanical exhaust system, commercial stoves shall not be allowed;

13. Storage space shall be clean and well ventilated; containers of food shall be covered and stored above the floor on shelves or other clean surfaces;

14. The kitchen shall have sufficient floor space and equipment to meet dietary needs and shall be conveniently located to dining areas;

15. The indoor and outdoor areas of the ,group home shall be maintained in a safe and sanitary manner,

16. All exterior areas of the group home shall be clean and free from garbage or rubbish and hazards of safety; lawns, hedges, and bushes shall be kept trimmed and shall not be permitted to become overgrown and unsightly. Fences shall be kept in good repair,

17. The exterior of the premises' shall be maintained free of all nuisances, unsanitary conditions, or any other hazards to the health, safety and welfare of the clients;

18. The premises shall be properly graded and provided with drains to dispose of surface water,

19. Rear and side yards must be fully enclosed by fencing which otherwise meets the requirements of the borough;

20. The accumulation of garbage or waste shall be prevented; all waste containers shall be provided with tight-fitting covers and shall be sufficient in size and number to contain accumulated waste;

21. Floors, walls, ceilings and other surfaces shall be kept clean and in good repair. These areas shall be covered, repaired or painted when necessary and only lead free paint shall be used;

22. On-site parking by more than four cars shall be prohibited.

H. For purposes of general ingress and egress from the residence:

1. A-sufficient number of doors, corridors, ramps or walkways and landings shall be provided and be wide enough to permit use by residents or visitors having wheelchairs, braces, walkers or any other prosthetic equipment or devices. Ramps shall have a grade not greater than the equivalent of one foot rise for every twelve feet of length. Handrails shall be provided on both sides of the ramps.

I. This chanter is not intended to authorize any construction which must be done in order to comply with any requirements set forth herein or any requirement imposed by federal, state, county or other municipal law. Any such authorization must be obtained and permits issued pursuant to all pertinent laws and/or ordinances.

J. No permit shall be granted to any community residence for developmentally disabled if such residence would be located within one thousand five hundred feet of an existing residence or a community shelter for victims of domestic violence (as the term "community shelter for domestic violence" is defined in N.J.S.A. 40:55D-66.1) or if the number of residents other than staff, at existing community residences or community shelters within the borough exceeds fifty persons or .5 percent of the population of the borough, whichever is hi -her.

K. The planning board shall grant -or deny an application for a conditional use with ninety-five days of submission of a complete application to the secretary of the planning board or within such further time as may be consented to by applicant. (Ord. 1101 § 1, 1985: Ord. 820 § 6.400, 1963)
